Terms and Conditions
1. Welcome to MyPublicInbox.
Thanks for your interest in our respectful messaging exchange service (the “Services”).
By using our Services, you agree to (1) these Terms of Service, (2) our Content Policies and (3) the Normas de uso de MyPublicInbox (collectively, the “MyPublicInbox Terms”). If ever in conflict, these Terms of Service will take precedence over any other terms in the policies and guidelines enumerated in numbers (2) and (3) above. Please read these Terms of Service and the rest of the MyPublicInbox Terms carefully.
As used in these Terms of Service, “you” means the individual or entity using the Services (and/or any individual, agent, employee, representative, network, parent, subsidiary, affiliate, successor, related entities, assigns, or all other individuals or entities acting on your behalf, at your direction, under your control, or under the direction or control of the same individual or entity who controls you). “We,” “us” or “MyPublicInbox” means MyPublicInbox, S.L., and the “parties” means you and MyPublicInbox.
2. Access to the Service; MyPublicInbox Profiles.
Your use of the Services is subject to your creation and our approval of a MyPublicInbox Profile (a “Profile”). We have the right to refuse or limit your access to the Services. In order to verify your Profile, from time-to-time we may ask for additional information from you, including, but not limited to, verification of your name, address, and other identifying information. By submitting an application to use the Services, if you are an individual, you represent that you are at least 18 years of age. You may only have one Profile. If you are a Contactor your Profile will not be Public and it will only be visible to the Public Profiles you have previously contacted with.
3. Using our Services.
You may use our Services only as permitted by the MyPublicInbox Terms and any applicable laws. Don’t misuse our Services. For example, don’t interfere with our Services or try to access them using a method other than the interface and the instructions that we provide.
You may discontinue your use of any Service at any time by writing an email to info@mypublicinbox.com and asking us to eliminate your Profile.
4. Changes to our Services; Changes to the MyPublicInbox Terms
We are constantly changing and improving our Services. We may add or remove functionalities or features of the Services at any time, and we may suspend or stop a Service altogether.
We may modify the MyPublicInbox Terms at any time. We’ll post any modifications to the Terms of Service on this page and any modifications to the MyPublicInbox. Changes will generally become effective 10 days after they are posted. However, changes addressing new functions for a Service or changes made for legal reasons will be effective immediately. If you don’t agree to any modified terms in the MyPublicInbox Terms, you’ll have to stop using the affected Services.
5. Terms definition.
Message Unit: A message unit corresponds to a text of between 200 and 1000 words, depending on the Public Profile.
Message: A message may comprise one or more message units.
Price of the Message Unit: The price that each Public Profile puts to the reading and response of one Message Unit.
Tempo: Virtual credit created by MyPublicInbox allowing the payment of the Message Units sent to a Public Profile.
6. Tempos Purchase Process.
Purchasing Tempos at MyPublicInbox is really easy by following the steps bellow:
- Select the Tempos Pack you would like to purchase according to your needs (you may visit the Public Profile of the person or organization you would like to communicate with in order to know the price). During the purchase process you will have all the necessary information, anyway if you need further information at any moment, please do not hesitate to contact us (info@mypublicinbox.com, Leire, Héctor).
- Once have selected the Tempos pack you want to purchase you should select “Checkout” in order to proceed with the payment.
- Before finalizing the payment you will be shown your Purchase Order for review including the pack/s you have selected. After reviewing it you should “Confirm” your Purchase.
- In order to correctly finalize a purchase you must be holder of a MyPublicInbox Profile (Public or Concactor one) and you must be logged on. If you are not logged on you will be given the option to Log In or Register. Depending on your situation you should Log In (if you already have a Profile) or Register (in the event you have not done that already).
- Finally, you should select the payment method between the options offered (see section 7).
- Once you have finalized the purchase process you will receive a message from MyPublicInbox including your purchase details. Additionally, your new purchase should be reflected in your account balance after a few moments. If you do not receive the message within 24 hours or if you do not see the purchase reflected in your account balance, please contact us: info@mypublicinbox.com.
7. Payment Methods
MyPublicInbox will never get or manipulate any bank data for the payment process. All the payment data and information is treated directly by PayPal allowing MyPublicInbox S.L. to offer you the transparency, security and confidentiality in your transactions.
The payment service provided by PayPal offers you two payment methods:
- Credit or Debit card VISA, MASTERCARD and American Express
- PayPal Account
And both are equally safe and directly admistrated by PayPal.
8. Taxes
The IVA Taxes are always includes in the price of any Tempos pack. After completing your Purchase you will receive an email including the corresponding invoice in your name with the personal data facilitated during the purchase process.
9. Prices Policy
The prices of the Tempos packs are quoted in € and are valid, except for typographical errors. In the event that a manifest error has happened in the pricing of a Service, the price of the service established in the informative email sent when the error is detected shall prevail over the wrong one.
The price of a Message Unit for each Public Profile is published in the URL. The holder of each Public Profile fixes the price for the reading and answer of one Message Unit. In the event that there is a price difference between the moment when you sent the message and the moment it is answered by the Public Profile, the price when you sent the message shall prevail.
10. Tempos Pays and Refunds
Each time you press “Send” for sending a message to a Public Profile the price of that message quoted in Tempos shall be advised and a you will be asked to confirm you want to send it. Once the message has been sent its cost in Tempos will be deducted from your cash balance.
After sending a message you will be informed about the maximum period for receiving the answer. If that deadline expires and you have not received an answer you will receive the reimbursement of the Tempos you spent in that communication. The new Tempos balance shall be updated including the refund within 24h after the deadline expiration.
11. Termination and Suspension
MyPublicInbox S.L. terminates your Profile due to your breach of the MyPublicInbox Terms, including, but not limited to, your causing or failing to prevent invalid activity, or your failure to otherwise fully comply with the MyPublicInbox Policies, you will not be entitled to any further payment from MyPublicInbox, S.L. for any balance outstanding associated to your Profile. If you breach the MyPublicInbox Terms or MyPublicInbox, S.L. suspends or terminates your Account, you are prohibited from creating a new Profile.
You may terminate your use of the Services at any time by sending an email to info@MyPublicInbox.com. Your MyPublicInbox Profile will be considered terminated within 10 business days of MyPublicInbox’s receipt of your notice. If you terminate your Profile and the balance reflected in your Profile below the threshold will remain unpaid.
12. Admission Right
MyPublicInbox services are kept private, and hence, we may exercise our right to access. By creating a Profile (Register process) implies the full acceptance without any reservations of its terms and conditions. Otherwise, MyPublicInbox, S.L. will make use of its admission right by terminating the corresponding Profile without prior announcement. No cash will be refund in that case.
13. Testing
You authorize MyPublicInbox, S.L. to periodically conduct tests that may affect your use of the Services. To ensure the timeliness and validity of test results, you authorize MyPublicInbox, S.L. to conduct such tests without notice.
14. Privacy
Our privacy policy explains how we treat your personal data and protect your privacy when you use our Services. By using our Services, you agree that MyPublicInbox, S.L. can use such data in accordance with our privacy policy. You and MyPublicInbox, S.L. also agree to the MyPublicInbox, S.L. Controller Data Protection Terms.
15. Limitation of Liability
Nothing in this MyPublicInbox Terms and Conditions shall exclude or limit either party’s liability for (a) fraud or fraudulent misrepresentation; (b) death, personal injury resulting from negligence; or (c) anything else that cannot be limited or excluded by law.
Neither of the parties shall be held responsible or shall be considered at fault under these Terms and Conditions (contractual or extracontractual) of any indirect or consequential special damages or losses (even if that loss or damage was foreseeable, which occurs during the use of the Services).
The aggregate liability of each of the parties under these Terms and Conditions (contractual or extracontractual) shall not exceed 125% of the quantity payable by MyPublicInbox, S.L. during the 12 months immediately preceding the date on which this liability is claimed.
16. Miscellaneous
Entire Agreement; Amendments. The MyPublicInbox Terms and Conditions are our entire agreement relating to your use of the Services and supersede any prior or contemporaneous agreements on that subject. The MyPublicInbox Terms may be amended (i) in a writing signed by both parties that expressly states that it is amending the MyPublicInbox Terms, or (ii) as set forth in Section 4, if you keep using the Services after MyPublicInbox, S.L. modifies the MyPublicInbox Terms.
Assignment. You may not assign or transfer any of your rights under the MyPublicInbox Terms.
Independent Contractors. The parties are independent contractors and the MyPublicInbox Terms do not create an agency, partnership, or joint venture.
No Third-Party Beneficiaries. Other than as set forth in Section 12, the AdSense Terms do not create any third-party beneficiary rights.
Severability. If it turns out that a particular term of the MyPublicInbox Terms is not enforceable, the balance of the MyPublicInbox Terms will remain in full force and effect.
Governing Law; Venue. All claims arising out of or relating to the MyPublicInbox Terms or the Services will be governed by Spain law, and will be litigated exclusively in Madrid courts.
Force Majeure. Neither party will be liable for inadequate performance to the extent caused by a condition (for example, natural disaster, act of war or terrorism, riot, labor condition, governmental action, and Internet disturbance) that was beyond the party’s reasonable control.
Communications. In connection with your use of the Services, we may contact you regarding service announcements, administrative messages, and other information.
